The train cemetery in Fabrica di Roma

The history, our past, are disaappearing slowly, day after day, destroyed with stones by vandals, raging in the old trains of the railway line North Rome.
Seats ripped, torn linings, ceiling lights and lamps removed, pieces of stolen train and then rocks, many rocks on the floor of the trains. They are the ones who have destroyed and are destroying the windows of the old trains parked. The graffiti artists have not forgotten to participate in this celebration of the devastation. The sides of the trains are full of incomprehensible writings, then paper, newspaper, plastic bags full of rags.

The rust begins to play its part, "eating" slowly all the metals not painted. Cobwebs everywhere and then more time decay. On these trains have traveled our grandfathers, our fathers, if they could tell, talk, tell stories, the ups and downs experienced by millions of people who have used them, we would be stunned. On these trains passed  the war, the hunger, the black market, the fear of bombing. There was then the first class, dedicated to  nazi occupation troops, on these convoys someone said that it was carried gold of  Italy Bank kept in the bowels of Mount Soratte, then from Sant'Oreste in Fabrica di Roma was hijacked in part on line Capranica - Civitavecchia.

It is on these trains that Catalano workshop has done miracles. Under the direction of his father and then by his son Maestri, they have been dismantled, repaired. The spare parts  hard to find  have been created from nothing.  It is under the direction of  the great Sergio Maestri, which took place extraordinary things. When the carriages of the trains, due to worn and time were cracking becoming unserviceable, were removed, split, welded, refurbished. He was  one who loved this railroad, he was one that without much paperwork  assumed responsibility and he made traveling people.

Someone respectful of the past would like to buy these old cars, but transfer costs are high, about 7,000 euro. Maybe restore and put some old drive to one of the many stations, it would be an excellent initiative, this would avoid the high costs of transport.

I resume below what I wrote in the article n. 61 "Do not destroy our history"
"Legislative Decree 42/2004 and subsequent amendments are clear. Part Two - Title 1 Protection - Chapter 1, the object of protection, Art, 10, is clear: " Are cultural heritages, immovable and movable things belonging to the State, regions, other local governments, as well as any public institution and private legal non-profit organization, presenting artistic, historical, archaeological or ethno-anthropological interest.

More precise it is 'Article 11 of this Decree. In fact to the letter g) specifies that the means of transport with more than seventy-five years, are goods subject to specific protective provisions.
Morever, Article 12 specifies that immovable things (buildings) and movable property referred to in Article 10, paragraph 1, which are the work of the author  no longer living, the execution of which date back more than fifty years are goods for protection, until it has been carried out  the verification of cultural interest. In fact, according to paragraph 2 of Article 12 specifies that the competent organs of  Ministry, on its own motion or at the request formulated by the parties to whom things belong, verify the existence of artistic, historical, archaeological or ethno-anthropological interest.

Therefore the beautiful small stations located along the line, should be saved from the degradation to which they are subjected. As a result of the law (OPE LEGIS) rolling stock and fixed installations should already be bound without specific Administrative Acts.

Their demolition, alienation or abandonment unauthorized would be prohibited by law, with criminal sanctions in case of violation of the rules.
 

According to art. 20 Comma 1 ) cultural heritage can not be destroyed, damaged or used for purposes that are incompatible with their historic character.

With regard to  declaration Procedure (Article 14, paragraph 1), the superintendent initiate proceedings for a declaration of cultural interest, even a reasoned request from the region and any other local authority concerned.

Article. 30, concerning the conservative obligations, specifies that the State, the regions, other local authorities and any other public body and institution, have an obligation to ensure the safety and preservation of the cultural heritage of their properties (coma 1) and are required to preserve them (paragraph 2). Even the simple abandonment (for example vandals) is a criminal offense. For the sale of goods under bond it is required  an authorization from the Ministry (Article 56).

The Fourth Part concerning  Sanctions according  Article 1 paragraph .160  it is determined that, due to the violation of the obligations to protect and conserve a well is damaged, the Ministry order to responsible the executing at his own expenses  the works reduired to reintegration.

In case of non-compliance, the Ministry responsible  ensure by office expenses of obligor (Article 160, paragraph 3).

It is  punished with imprisonment from six months to one year and a fine of between € 775 to € 38,734.50 anyone allocates cultural properties indicated to  incomparable use with their historical or artistic or detrimental to the preservation or integrity . Who fails to give notice to the competent supervision of the movement of cultural goods (change of residence) shall be punished with the same penalty (Articles 170 to 171 Misuse - Placing and removing illegal).

It is punished with imprisonment up to one year and a fine of € 1,549.50 to € 77.469 anyone without the required authorization gives cultural listed property, or omitted the reporting of acts of transfer of ownership or possession of cultural goods  ( Articles. 173 Violation arrangements for disposal).

Failure to comply of administrative measures (art. 180) unless the fact constitutes a more serious offense, says: anyone fails to comply with an order given by the authority in charge of the protection of cultural property, shall be punished with the penalties provided for in Article 650 of the Criminal Code.

According to art. 733 of the Criminal Code anyone who destroys, damages a monument or something else which is known to own the relevant value, shall be punished with imprisonment up to one year or a fine of not less than €  2.065, if it results in detrimental to the archaeological, historical or artistic heritage.

The judiciary could, in case of violation, realize the preventive seizure of property  threatened and proceed with their custody to the owners under their responsibility, as "legal guardians".

The APSAE of Lazio (via Cavalloti n. 2 - Rome) was informed of the existence of this heritage, its state of abandonment and destruction, until now it has not been seen any intervention. Who will be held accountable for omission of this state of desolation, devastation?
